These Terms of Service ("Terms") govern your use of Presencely ( "the app", "we", "our"), an offline-capable attendance, events, RSVP, and polling app for colleges/institutions and standalone events. By creating an account or using the app, you agree to these Terms. If you don't agree, please don't use the app.
Presencely is developed and published by an individual developer, contactable at support@qwickwave.com. See also our Privacy Policy, which these Terms incorporate by reference.
1. Who can use Presencely
You must be able to form a binding agreement to use the app. If you're using Presencely as a student through your school/college, your institution's own policies (and, where applicable, parental/ guardian consent obtained by that institution) also govern your use — see the Privacy Policy's Children's Privacy section.
2. Accounts
- You're responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
- You're responsible for activity that happens under your account, except where it results from our own security failure.
- Institution admins, workplace owners, and event organizers are responsible for the accuracy of the records they create and for managing who has access within their own institution/workplace/ event.
3. Acceptable use
You agree not to:
- Use the app to mark attendance for someone else, or otherwise falsify attendance, RSVP, or poll records.
- Attempt to access another person's, institution's, workplace's, or event's data without authorization.
- Interfere with the app's operation (e.g. attempting to disrupt Bluetooth-based attendance for others) or attempt to bypass its security controls.
- Use the app for any unlawful purpose, or in a way that violates the rights of others.
4. Institutional, workplace, and event content
Colleges/admins, workplace owners, and event organizers are responsible for the accuracy and lawfulness of the structures, rosters, and content they create in the app (programs, sections, subjects, shifts, events, polls). We provide the platform; we don't independently verify institution-, workplace-, or event-specific data.
5. Service availability
Presencely is designed to keep working offline for attendance marking and syncs when a connection becomes available (see the Privacy Policy for details), but we don't guarantee the app or its backend services will be available uninterrupted or error-free. Features that require a live connection (e.g. syncing across devices) may be unavailable during outages.
6. Termination
You can stop using the app and delete your account at any time (see the Privacy Policy's Data Retention section for what that does and doesn't remove). We may suspend or terminate accounts that violate these Terms, including the Acceptable Use section above.
7. Disclaimer of warranties
The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including — to the extent permitted by applicable law — implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be error-free, secure, or available at all times.
8. Limitation of liability
To the maximum extent permitted by applicable law, Presencely and its developer won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the app.
9. Changes to these Terms
If these Terms change, we'll update the "Last updated" date in the footer below. Material changes will be reflected here before they take effect, and where practical we'll also note them in-app.
10. Governing law
These Terms are governed by the laws of the developer's home jurisdiction, without regard to conflict-of-law principles, unless a different jurisdiction is required by applicable consumer- protection law where you live.
